Florio Kenny Raval, LLP recently won total disability benefits for a client in a Workers’ Compensation case litigated by the firm’s Certified Workers’ Compensation Attorney, Keith Kandel, Esq.
The injured worker sought legal representation after the insurance company terminated his pain-management treatment following a 4-level cervical fusion. The worker, however, had continued complaints of pain.
Mr. Kandel negotiated a “Need for Treatment” examination with a pain management specialist who recommended continued pain management treatment and an MRI of the right shoulder. The MRI revealed a rotator cuff tear which was then operated upon.
The client also experienced depression as he was his family’s sole bread-winner and was never able to return to work after his accident. The insurance company ignored the client’s requests for psychiatric treatment, and the firm filed a successful Motion for Temporary and/or Medical Benefits.
As a result of the firm’s successful court action, the client received psychiatric treatment consisting of medication and therapy, which will be on-going following the conclusion of the case.
Mr. Kandel ultimately won Permanent Total Disability for the client—the maximum amount of benefits permitted by law—which included lifetime treatment for the neck, shoulder, depression, and pain management.
